1. Who We Are and What This Policy Covers

This Privacy Policy explains how Deleks USA, Inc. ("Deleks USA", "we", "us", "our") collects, uses, discloses and protects personal information when you visit deleks.net , place an order with us, contact our customer support, or otherwise interact with us (together, the "Services").

Deleks USA, Inc. is a Texas corporation with its registered office at 1800 West Loop S, Ste 1600, Houston, TX 77027, United States. Deleks USA, Inc. is the business responsible for the personal information collected through the Services.

Deleks USA, Inc. is an affiliate of DELEKS S.r.l. (Verolanuova, Italy), the manufacturer of DELEKS® machinery. Section 11 explains when your information may be shared with our Italian affiliate.

This Policy does not apply to deleks.it, deleks.eu or other DELEKS websites operated outside the United States, which have their own privacy notices.

2. Personal Information We Collect

We collect the categories of personal information described below. The category names follow the terminology used in U.S. state privacy laws.

Sensitive personal information. We do not collect or process sensitive personal information as defined by U.S. state privacy laws — including racial or ethnic origin, religious beliefs, health information, precise geolocation, biometric or genetic data, or information about sexual orientation. We do not ask for this information and we ask that you do not send it to us.

Payment card details. We do not store your full payment card number. Card payments are processed by our payment providers, who receive your card details directly. We receive only limited information such as the card type, the last four digits and the authorization result.

3. How We Use Personal Information

We use personal information for the following business purposes:

to process, fulfill and ship your orders, and to arrange freight delivery;
to take payment and to detect and prevent fraudulent or unauthorized transactions;
to communicate with you about your order, delivery, returns and warranty claims;
to notify you when a product you asked about comes back into stock, if you request it;
to provide customer and technical support, including product compatibility advice;
to administer your account, if you create one;
to handle warranty claims and to maintain product safety and traceability records;
to comply with legal obligations, including tax, customs, import, and product safety requirements;
to operate, secure, maintain and improve the Services;
to measure how our own store is used, so that we can improve it;
to establish, exercise or defend legal claims.

We do not use your personal information to show you advertising on other websites or social media platforms, and we do not build advertising profiles about you.

We do not make decisions about you that produce legal or similarly significant effects through automated processing alone.

4. How We Disclose Personal Information

We disclose personal information to the following categories of recipients, for the purposes described above. Each of these acts on our behalf and is contractually restricted from using your information for its own purposes.

We do not disclose personal information to third parties for their own independent marketing purposes.

5. We Do Not Sell or Share Your Personal Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined by U.S. state privacy laws. We have not done so in the preceding twelve months, and we do not sell or share the personal information of consumers under 16 years of age.

We do not use advertising pixels or tracking technologies that transmit your browsing activity to advertising platforms.

If this ever changes, we will update this Policy and provide the opt-out mechanisms required by law before any such technology is enabled.

6. Cookies and Similar Technologies

We use cookies and similar technologies to operate the site, keep you signed in, remember your cart and preferences, and understand how our own store is used. We do not use advertising or cross-site tracking cookies.

Our Cookie Notice, listing the cookies used, their purposes and their duration, is available at deleks.net/pages/cookie-notice.

You can manage or delete cookies through your browser settings. Blocking essential cookies will prevent parts of the site, including checkout, from working.

Global Privacy Control. Because we do not sell or share personal information or engage in targeted advertising, there is no sale or sharing for a GPC signal to opt out of. We will honor GPC signals if our practices change.

7. Your Privacy Rights

Depending on the state in which you live, you may have some or all of the following rights:

Access / know — to confirm whether we process your personal information and to obtain a copy of it, together with the categories of information, the sources, the purposes, and the categories of recipients;
Correct — to have inaccurate personal information corrected;
Delete — to have your personal information deleted, subject to exceptions such as completing a transaction, handling a warranty claim, product safety records, and legal, tax and customs record-keeping obligations;
Portability — to receive a copy in a portable, machine-readable format;
Opt out — of the sale or sharing of personal information, of targeted advertising, and of profiling that produces legal or similarly significant effects. As explained in Section 5, we do not carry out any of these activities;
Limit the use of sensitive personal information — although, as stated in Section 2, we do not collect it;
Non-discrimination — we will not deny you goods or services, charge you a different price, or provide a different level of service because you exercised a privacy right

How to submit a request. Email quotes@deleks.com , call (866) 384-3461, or write to the address in Section 14.

Verification. To protect your information, we will ask you to verify your identity before we act on a request — normally by confirming information we already hold, such as an order number and the email address used to place it. We cannot fulfill a request we are unable to verify.

Authorized agents. You may use an authorized agent to submit a request. We will ask for written proof of authorization and may ask you to verify your own identity directly.

Timing. We respond within 45 days, and will tell you if we need a further 45 days.

Appeals. If we decline your request, you may appeal by writing to quotes@deleks.com with "Privacy Appeal" in the subject line. We will respond within 45 days explaining our decision. If your appeal is denied, you may contact your state attorney general.

8. California Residents

In addition to the rights above:

Notice at collection. The table in Section 2 serves as our notice at collection, describing the categories collected, the purposes, and the fact that we do not sell or share them.
Shine the Light. We do not disclose personal information to third parties for their own direct marketing purposes.
Retention. Section 9 sets out our retention periods.

9. How Long We Keep Personal Information

When a retention period ends, we delete the information or de-identify it so that it can no longer be linked to you.

10. Security

We use appropriate technical and organizational measures to protect personal information against unauthorized access, loss, misuse and alteration, including encryption in transit, access controls, and the security measures provided by Shopify as our platform. Access to customer data is limited to personnel who need it to do their jobs. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. International Transfers

Deleks USA, Inc. is part of an Italian group. Personal information may be transferred to, and accessed from, Italy and other countries where our affiliates and service providers operate, including for technical support escalation to the engineering team that designed the product, and for warranty administration.

These countries may have data protection laws different from those in the United States. Where we transfer information internationally, we take steps to ensure it remains protected in accordance with this Policy.

12. Children's Privacy

The Services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of consumers under 16. If you believe a child has provided us with personal information, contact us at quotes@deleks.com and we will delete it.

13. Changes to This Policy

We may update this Policy from time to time. We will post the updated version on this page and change the "Last updated" date. If we make material changes, we will notify you by email or by a prominent notice on the site before the changes take effect. Your continued use of the Services after the effective date means you accept the updated Policy.
